Terms of Use

Article 1 Scope

The purpose of the following general sales conditions is to govern the relations between :

• the company Speedlingua SA, 275 route d’Arlon L-8011 Strassen, Luxembourg, editor of the website www.speedlingua.com, and
• the Internet user who has accepted the general conditions by agreeing with them when placing an order on www.speedlingua.com, hereafter referred to as the customer.

Article 2 Products

1. The products for sale are described on the website www.speedlingua.com  at the time of sale. The characteristics of the Products as well as photos are established in agreement with the supplier and are only given as an indication.
2. Products are available on the website during the selling period provided they are in stock.

Article 3 Price and shipping charges contribution

1. Prices are net, in Swiss francs for Switzerland and in Euros for all other countries, all taxes included; they are applied during the entire selling period.
2. For physical deliveries of CDs inside European Community and in Switzerland, Speedlingua covers the payment of the VAT amount as well as customs duties (Delivery Duty paid). For delivery outside European community or Switzerland, the buyer commits himself to paying all the import taxes, Customs duties and Value Added Tax in compliance with the laws of the country where the goods are to be delivered.
3. To the indicated prices will be added the shipping charges that appear on the “basket” section of the order form.
4. All price changes made by Speedlingua SA will become effective only when published on the website www.speedlingua.com. New prices are applicable as from their publication to all new orders. Such price will not give customers who purchased the product before the price change the right to request a reimbursement.

Article 4 Sale closing; payment ; confidentiality

1. A sale is closed once the customer has confirmed his purchase by clicking on the button “validation” and once a confirmation has been sent to him via email.
2. The price of items purchased on the website www.speelingua.com is due at the time of the order, with no discount. In all countries, the payment is made by credit card (Visa, Mastercard, American Express) and is processed through a secured process using the Internet’s current protocols, by way of the card number and name of the card holder, the credit card’s expiration date and the cryptogram. For some countries in which customers live, other paying methods are available, such as debit cards, local bank transfer, pay per invoice, eWallet, Carte Bleue, and so on. The payment methods in various countries depend on Speedlingua’s providers, i.e. Clickandbuy or Paypal.
3. Speedlingua SA has no access to the confidential information related to your payment method. Required information is encrypted and transmitted to the company Clickandbuy or Paypal in a secured manner without Speedlingua SA or a third party having access thereto.
4. Speedlingua SA has the right to refuse to deliver or to process an order for a customer who has not fully or partially paid a previous purchase or with whom a payment dispute is currently underway.

Article 5 Delivery

1. For physical shipments of CDs, products are sent to the shipping address indicated by the customer during the ordering process. For electronic orders, the download parameters are directly sent to the customer.
2. Unless otherwise specified at the time of validation of the order, the period of delivery of CDs is 30 days. This period is indicative. The delivery does not include installation or commissioning of the ordered product or the return of old material. Deliveries are made by various specialized transporters based on the nature of the order and the delivery address. As a result, the delivery time and costs vary according to the transporter. In order to track his shipment, the customer receives an email when the product is dispatched (from our warehouses).
3. Speedlingua SA undertakes to inform the customer of any delay in delivery. No indemnity can be claimed from Speedlingua SA in this regard.
4. The amount of shipping costs are indicated in the “basket” section and are subject to the customer’s approval before validating the order. Preparation and shipping costs are to be paid by the customer.

Article 6 Warranty in case of defects; right of return

1. If the product has a defect, Speedlingua SA’s warranty only covers the product’s return and reimbursement of the price, provided that the customer has observed the conditions and deadlines indicated in the next paragraph.
2. Independently of the existence of defect, the customer has the right to return a product within the 7 (seven) days that follow the receipt of his order. He can thus benefit from the right to return a product that is not satisfactory at no extra cost. This right of return does not apply to online software downloads. Should the customer exercise his right of return, the shipping costs to return the order are paid by the customer. The order will only be returned if the products are neither damaged nor downloaded by the customer. Items which have been downloaded or returned which are damaged, incomplete, spoiled or made dirty by the customer will not be accepted or reimbursed. Prior to returning an item, the customer must get in touch with Speedlingua SA at the following address: return@speedlingua.com in order to receive his material return authorization (MRA) as well as all the information about the return procedure.
3. Any return request received by Speedlingua SA after 7 (seven)day deadline, for any reason whatsoever, cannot be accepted. The risks related to return of this product are the customer’s responsibility, whatever the cause of the return may be.
4. If a return does comply with paragraphs 6.1 and 6.2 above, the price paid will be refunded as follows:
   
   • if the return is due to a shipping error of Speedlingua SA or by way of the exercise of the right of return, by crediting the debited amount back to the credit card.
   • in any other case, by offering the customer a gift voucher corresponding to the value purchased on the website www.speedlingua.com.

Article 7 Conditions of use of the website

1. The use of the website www.speedlingua.com is authorized for private use only. Any commercial use, especially for the purpose of reselling products bought on the website to third parties, is forbidden.
2. All communications are made only via emails sent to the following address: contact@speedlingua.com.

Article 8 Data protection

1. With regard to the use of the customer's data, Speedlingua SA conforms to the current law, notably the data protection law. Speedlingua SA only deals with and keeps data which are necessary for the good accomplishment of its services and the invoicing therefore.
2. The customer accepts that Speedlingua SA uses his data for the conception and development of its services and for the elaboration of tailored offers for him. Speedlingua SA will not transmit his data to third parties.
3. The customer benefits from a right to access, modify or remove nominative data about him. The customer can exercise this right at the following address: contact@speedlingua.com. Unless the customer disagrees, Speedlingua SA may send him messages, including emails, regarding products and services similar to the ones he has subscribed to.

Article 9 Modification of general conditions

1. The above general conditions may be modified anytime by Speedlingua SA.
2. It is the customers’ responsibility to regularly stay up-to-date with the content and potential modifications of the above general conditions by visiting the following url: www.speedlingua.com.

Article 10 Venue

1. For any dispute between Speedlingua SA and the customer, the venue shall be at the seat of the company Speedlingua SA in Luxembourg. Mandatory venues are reserved.
